Welcome to JamiiTrade, a digital platform for young businesses trading across borders in Africa, designed to foster community learning and growth. Please read these Terms and Conditions ('Terms') carefully before using our platform.
1. Definitions:
1.1. "Service" refers to the access and use of the JamiiTrade platform, including but not limited to, its website, mobile application, content, products, goods, services, software, tools, features, emails, newsletters, databases, forums, networks, and functionality provided by JamiiTrade.
1.2. "User", "You", and "Your" refer to the individual, company, or organisation that has visited or is using the website or service. A User may be a visitor to our website, a user of one or more of our Services (“User”), or a customer of JamiiTrade.
1.3. "JamiiTrade", "We", "Us", and "Our" refer to JamiiTrade as a platform, including its employees, directors, officers, affiliates, and agents.
1.4. "Content" refers to text, images, graphics, data, information, and other material that can be viewed by Users on our Service.
1.5. "User Content" refers to all Content added, created, uploaded, submitted, distributed, or posted to the Services by Users.
1.6. "Third-Party" refers to any application, company, service, or individual that is not owned or operated by JamiiTrade.
2. Acceptance of Terms: Your access to and use of the JamiiTrade Services is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
3. Age Requirement: You must be at least 18 years of age to agree to and enter into this Agreement on your own behalf and to register for use of this Service. If you are under 18 but at least 15 years of age, you must present this Agreement to your parent or legal guardian.
4. Registration: You will be required to register to access our Services. You agree to keep your password confidential and will be responsible for all use of your account and password.
5. User Conduct: You agree not to use the Service for any illegal purposes, and you will respect all applicable laws and regulations while using our website. You must not transmit any malicious or disruptive software. Any breach of this provision would lead to the immediate termination of your use of our Service.
6. Content: The content on our Service is provided for general information only. It is not intended to amount to advice on which you should rely.
7. System Generated Messaging: From time to time the Service will include messaging and information related to your profile that will be sent to you. You will have the option to opt-out anytime if you do not want to receive these messages.
8. User Generated Content: You are responsible for the content, such as text, images, and other material that you post on the Service ('User Content'), its legality, reliability, and appropriateness. You retain all rights to and are solely responsible for the User Content you post on the site.
9. Intellectual Property Rights: The Service and all contents, excluding User Content but including but not limited to text, images, graphics, or code are the property of JamiiTrade and are protected by copyright, trademarks, database and other intellectual property rights.
10. Privacy and Data Security: Any personal information you provide to us will be handled in accordance with our Privacy Policy. We take user data protection and security seriously, and we maintain reasonable safeguards to protect against unauthorised access, use, or disclosure.
11. Termination: We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. You may terminate your use of the Service at any time, either by ceasing to access them, or by contacting us at info@jamitrade.africa.
12. Limitation of Liability: In no event will JamiiTrade, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from
12.1. your access to or use of or inability to access or use the Service;
12.2. any conduct or content of any third party on the Service;
12.3. any content obtained from the Service; and
12.4. unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
13. Changes to Terms: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
14. Dispute Resolution: If you have any dispute with us, you agree that before taking any formal action, you will contact us at info@jamitrade.africa, and provide a brief, written description of the dispute and your contact information (including your username, if your dispute relates to an account). Except for intellectual property and small claims court claims, the parties agree to use their best efforts to settle any dispute, claim, question, or disagreement directly through consultation with each other, and good faith negotiations shall be a condition to either party initiating a lawsuit or arbitration.
15. Governing Law: These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.
By using JamiiTrade, you are agreeing to be bound by the aforementioned terms and conditions. If you do not accept all of these terms and conditions, please do not use our platform. Your continued use of the platform will constitute your acceptance of any changes or revisions to the terms and conditions.
